By accessing or using our website, you agree to be bound by the following Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and KINWIRTONE LTD (“we”, “us”, or “our”). If you do not agree with any part of these Terms, you must not use our services.
Definitions
- Platform: The online marketplace operated via https://designpromarket.com.
- Client: Any user who registers to request or purchase custom textile design services.
- Designer: A vetted service provider offering textile design services on the Platform.
- User: Any individual or entity that accesses, registers, or uses the Platform, including Clients and Designers.
- Services: Custom textile design services offered by Designers to Clients via the Platform.
Additional definitions
- 1 Day Notice: A requirement that either party must provide at least one (1) calendar day’s written notice to the other party for actions such as initiating or terminating a project, or making significant changes to the scope of work.
- 7 Day Notice: A requirement that either party must provide at least seven (7) calendar days’ written notice to the other party for actions such as initiating or terminating a project, or making significant changes to the scope of work.
- Limited Warranty: A warranty provided by the freelancer that covers specific aspects of the delivered work for a defined period. This warranty typically obligates the freelancer to address only certain issues or defects that arise under normal use, as explicitly stated in the agreement.
- Full Warranty: A comprehensive warranty wherein the freelancer commits to rectify any defects or issues in the delivered work without additional charges for a specified period. This warranty generally covers all parts and labor necessary to address problems arising under normal use.
Account Registration
You must be 18+ and provide truthful, complete information during registration. Your account is personal and must be kept secure.
Use of Platform
The Platform connects you with potential Clients. Design PRO Market does not act as your employer or agent and is not a party to your contracts with Clients.
Designer Responsibilities
As a Designer, you agree to:
- Deliver original, professional-quality work, free of plagiarism.
- Meet deadlines and fulfill project agreements.
- Maintain confidentiality and respect Client data and IP.
- Clearly communicate rights, usage, and licensing terms to Clients.
- Avoid accepting projects you cannot deliver.
Account Registration
Both Clients and Designers must create an account to access the Platform’s full features.
Users must be 18 years or older and provide accurate and complete information during registration.
You are responsible for maintaining the confidentiality of your account and for all activities under it.
Use of the Platform
The Platform is a venue for Clients and Designers to connect, communicate, and transact.
We do not directly provide design services but facilitate the introduction between Users.
All contracts for design work are made directly between Clients and Designers.
Intellectual Property
- You retain ownership of your original work unless otherwise agreed.
- You must not copy or use third-party content without proper licensing.
- Clients receive only those rights expressly granted by you in writing.
User Obligations
Clients agree to:
- Provide accurate project briefs and required assets.
- Make timely payments for services received.
- Communicate respectfully and clearly with Designers.
Designers agree to:
- Fulfill all contractual obligations agreed upon with the Client.
- Deliver original, high-quality work within agreed timelines.
- Maintain confidentiality and avoid copyright infringement.
Payments and Currencies
Payments are processed through secure third-party payment processors.
Supported currencies include: USD, KZT, EUR, AUD, CAD, CLP, CZK, HUF, IDR, JOD, OMR, NZD, NOK, PEN, QAR, SAR, AED, UZS, AZN, PLN.
Designers will receive payouts in their selected currency, subject to conversion and fees.
Any applicable VAT, GST, or local taxes are the responsibility of the User.
Dispute Resolution
In case of a dispute between a Client and a Designer, we may assist in mediating, but we are not obligated to resolve the matter.
Users are encouraged to resolve disputes in good faith.
All legal claims arising from or related to these Terms shall be governed by the laws of the United Kingdom.
Intellectual Property
Designers retain ownership of their original work unless otherwise agreed in writing.
Clients are granted usage rights as specified in the individual agreement with the Designer.
Users shall not reproduce, distribute, or exploit any content on the Platform without express permission.
Prohibited Activities
Users may not:
- Use the Platform for fraudulent or abusive activities.
- Violate any applicable laws or regulations.
- Post false, misleading, or infringing content.
Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
Users may delete their account at any time by contacting info@designpromarket.com.
Limitation of Liability
We do not guarantee any specific results from the use of the Platform.
We are not liable for any disputes, losses, or damages arising from interactions or transactions between Users.
Our liability is limited to the maximum extent permitted under UK law.
Privacy and Data Protection
We are committed to protecting your data in compliance with the UK GDPR and other applicable laws.
By using the Platform, you consent to the processing of your data as outlined in our Privacy Policy.
Our services support compliance with GDPR, SCA, and PSD2 regulations.
Changes to Terms
We reserve the right to update or modify these Terms at any time. The latest version will always be available on our website, with the “Last Updated” date posted above. Continued use of the Platform constitutes your acceptance of the revised Terms.
