Welcome to Design PRO Market (https://designpromarket.com), an online platform for textile designers to offer their services to a global client base. These Terms and Conditions (“Terms”) govern your use of the Platform as a Designer. By registering and offering your services, you agree to comply with these Terms. If you do not agree, please do not use the Platform.
Definitions
- Platform: The online marketplace at https://designpromarket.com.
- Designer: A registered service provider offering textile design services.
- Client: A user requesting or purchasing services.
- Services: Design services offered by you via the Platform.
- User: Any person using the Platform, including Clients and Designers.
Additional definitions
- 1 Day Notice: A requirement that either party must provide at least one (1) calendar day’s written notice to the other party for actions such as initiating or terminating a project, or making significant changes to the scope of work.
- 7 Day Notice: A requirement that either party must provide at least seven (7) calendar days’ written notice to the other party for actions such as initiating or terminating a project, or making significant changes to the scope of work.
- Limited Warranty: A warranty provided by the freelancer that covers specific aspects of the delivered work for a defined period. This warranty typically obligates the freelancer to address only certain issues or defects that arise under normal use, as explicitly stated in the agreement.
- Full Warranty: A comprehensive warranty wherein the freelancer commits to rectify any defects or issues in the delivered work without additional charges for a specified period. This warranty generally covers all parts and labor necessary to address problems arising under normal use.
Account Registration
You must be 18+ and provide truthful, complete information during registration. Your account is personal and must be kept secure.
Use of Platform
The Platform connects you with potential Clients. Design PRO Market does not act as your employer or agent and is not a party to your contracts with Clients.
Designer Responsibilities
As a Designer, you agree to:
- Deliver original, professional-quality work, free of plagiarism.
- Meet deadlines and fulfill project agreements.
- Maintain confidentiality and respect Client data and Intellectual Property.
- Clearly communicate rights, usage, and licensing terms to Clients.
- Avoid accepting projects you cannot deliver.
Payments and Payouts
- Client payments are collected via secure third-party payment processors.
- You will receive payouts in your chosen currency, minus applicable fees.
- You are solely responsible for tax compliance in your jurisdiction (VAT, GST, etc.).
Dispute Resolution
We encourage you to resolve conflicts directly with Clients. We may offer optional mediation, but are not liable for any outcome or obligated to intervene.
Intellectual Property
- You retain ownership of your original work unless otherwise agreed.
- You must not copy or use third-party content without proper licensing.
- Clients receive only those rights expressly granted by you in writing.
Prohibited Conduct
Designers may not:
- Upload stolen, misleading, or infringing materials.
- Contact Clients outside the Platform to avoid fees (“platform circumvention”).
- Fail to deliver on agreed work without just cause.
Termination
We may suspend or terminate your account for breach of these Terms or for any reason at our sole discretion. You may delete your account by contacting us at info@designpromarket.com.
Account Suspension
We may suspend or permanently disable your account for violations of these Terms, including repeated complaints or delivery issues. You may close your account by contacting info@designpromarket.com.
Limitation of Liability
We are not liable for:
- Your contractual disputes with Clients.
- Payment issues arising from non-compliance or failed delivery.
Our liability is limited under UK law.
Privacy and Data Use
Your data is collected and processed in line with UK GDPR and relevant data protection regulations. Please review our Privacy Policy for full details.
Updates to Terms
We reserve the right to revise these Terms at any time. Your continued use of the Platform implies acceptance of any changes.
